These Terms of Use (“Terms”) govern your access to and use of the Awakened Sways website and the products, content, resources, practices, services, experiences, and other offerings made available by or through Awakened Sways.
Throughout these Terms, “Awakened Sways,” “we,” “us,” and “our” refer to the business operating Awakened Sways. “You” refers to the visitor, customer, purchaser, participant, or other person using the website or an Awakened Sways offering.
By accessing or using this website, purchasing an offering directly from Awakened Sways, or participating in a service subject to these Terms, you agree to these Terms. If you do not agree, please do not use the applicable website, service, or offering.
1. Awakened Sways and the Nature of the Work
Awakened Sways creates movements, practices, realizations, choices, experiences, and disciplines that sway us back toward conscious alignment.
The work may include, now or in the future:

Reiki and energy-based wellness experiences;

guided journals, books, workbooks, prompts, and reflection tools;

guided meditations, visualization, breath, and awareness practices;

Life Path, Human Design, personal blueprints, and related reflective materials;

Return Experiences, including experiences such as Gift of Presence;

physical products, cards, letters, creative materials, and intentional objects;
-
digital downloads, recordings, educational resources, written materials, and other creative works;
-
classes, workshops, gatherings, community experiences, or other aligned offerings; and
-
other practices, resources, products, or experiences developed as Awakened Sways continues to evolve.

For purposes of these Terms, these are collectively referred to as the “Offerings.”
Not every Offering will be available at all times.
2. An Invitation, Not Authority Over You
Awakened Sways is built around awareness, questioning, reflection, personal responsibility, presence, and remembrance.
Our Offerings may invite you to observe thoughts, beliefs, patterns, experiences, emotions, choices, or perspectives. They are not intended to dictate who you are, what you must believe, what path you must follow, or what decisions you must make.
A journal, practitioner, blueprint, meditation, spiritual framework, question, or other sway may offer a place to begin, another perspective, or an opportunity to pause.
It does not possess authority over you.
You remain responsible for your own interpretations, choices, actions, beliefs, and decisions.
3. Spiritual and Personal Beliefs
Awakened Sways may contain discussion of spirituality, consciousness, energy, faith, the I AM, the Most High, and other spiritual or philosophical concepts.
Some expressions reflect the personal beliefs, experiences, questions, and understanding from which Awakened Sways was created.
You are not required to adopt those beliefs in order to engage with the work.
Awakened Sways does not represent JD, a practitioner, a system, a blueprint, a journal, or another person as possessing exclusive spiritual authority or the answers another individual must accept.
4. Wellness and Professional-Care Boundaries
Certain Awakened Sways Offerings relate to wellness, Reiki, energy practices, meditation, breath, reflection, or spirituality.
They are complementary and exploratory in nature and are not substitutes for appropriate medical, mental-health, psychiatric, legal, financial, or other licensed professional services.
Awakened Sways does not provide medical diagnosis or treatment through these Offerings and does not promise that an Offering will diagnose, treat, cure, or prevent a medical or mental-health condition.
Please read the separate Wellness & Spiritual Disclaimer, which is incorporated into these Terms by reference where applicable.
5. No Guarantee of Results
Experiences involving reflection, personal development, spirituality, meditation, journaling, Reiki, energy practices, and other forms of self-exploration are individual.
Awakened Sways does not guarantee a particular physical, emotional, spiritual, relational, professional, financial, or personal-development result from any Offering.
Your experience may differ from another person's experience.
6. Reiki and Energy-Based Experiences
Reiki and related energy practices are offered as complementary spiritual and wellness experiences.
They are not represented as medical treatment.
Participation is voluntary. You may ask questions, communicate boundaries, or discontinue participation at any time.
No specific energetic sensation, emotional experience, spiritual realization, health outcome, or other result is guaranteed.
7. Meditation, Breath, Visualization, and Reflective Practices
Meditation, breathing, visualization, grounding, awareness, journaling, and similar practices are provided for personal reflection, spiritual exploration, or general wellness.
You are responsible for determining whether participation is appropriate for your circumstances. You may pause, modify, or discontinue a practice at any time.
When a health condition, injury, pregnancy, medication, mental-health concern, or other circumstance raises a question about whether a practice is appropriate, seek guidance from an appropriately qualified healthcare professional.
8. Life Path, Human Design, and Personal Blueprints
Life Path, Human Design, personal blueprints, and related materials are offered as tools for reflection, personal exploration, and perspective.
They are not medical, psychological, scientific, legal, or financial assessments and are not presented as diagnoses, guarantees, or instructions determining who you are or what decisions you must make.
When an Offering requires birth-related or other information, you are responsible for providing information that is accurate to the best of your knowledge.
A blueprint may offer another lens through which to observe yourself.
It does not define you or possess authority over you.
9. Books, Journals, Prompts, and Return Experiences
Books, journals, reflection cards, questions, prompts, letters, Return Experiences, and related creative materials are intended to support reflection, presence, awareness, or personal exploration.
They are not diagnostic instruments or individualized professional advice.
Questions and prompts are invitations to observe and consider. There is no required “correct” response or interpretation.
10. Purchases
Prices, availability, descriptions, formats, and included materials may change from time to time.
Before purchasing, you are responsible for reviewing the description, price, delivery method, and other conditions shown for the applicable Offering.
We make reasonable efforts to provide accurate information. If a material error affects a transaction made directly through Awakened Sways, we will make reasonable efforts to address it.
11. Third-Party Platforms
Some Offerings may be purchased, scheduled, processed, delivered, printed, fulfilled, or otherwise supported by third-party platforms.
These may include bookstores, marketplaces, payment processors, scheduling services, print-on-demand providers, digital-delivery platforms, social platforms, or other providers.
Transactions through a third-party platform may also be governed by that provider's terms, privacy policy, refund policy, shipping policy, and other rules.
Awakened Sways does not control the independent operation, security, availability, or policies of third-party services.
12. Payment
When payment is required, you agree to provide accurate billing and transaction information and to pay the amount displayed or otherwise agreed upon for the applicable Offering.
Payment processing may be performed by a third-party provider.
Awakened Sways generally does not directly receive or store complete payment-card credentials processed independently by those providers.
13. Shipping and Physical Products
Physical products may be fulfilled directly by Awakened Sways or through third-party printers, marketplaces, fulfillment providers, or retailers.
Shipping times, availability, carrier performance, and delivery estimates may vary.
Any estimated delivery date is an estimate unless expressly stated otherwise.
Policies applicable to a purchase made through a third-party retailer or marketplace may be governed by that provider.
14. Digital and Personalized Offerings
Digital downloads and personalized Offerings may begin being prepared or delivered shortly after purchase.
Because personalized materials may be created specifically using information supplied by the purchaser, cancellation or refund options may differ from those applicable to non-personalized products, subject to applicable law.
Any applicable refund or cancellation conditions should be reviewed at the point of purchase.
You may not purchase one copy of a digital or personalized Offering and reproduce or distribute it for multiple people unless the Offering expressly permits that use.
15. Appointments, Cancellations, and Rescheduling
Appointments and scheduled experiences may be subject to cancellation, rescheduling, lateness, or no-show policies displayed during booking or communicated before the appointment.
Where a third-party booking platform is used, applicable platform terms may also apply.
If Awakened Sways must cancel or materially reschedule a directly booked paid service, reasonable efforts will be made to offer an appropriate rescheduling or refund option as applicable.
16. Returns and Refunds
Return and refund eligibility depends on the Offering, how it was purchased, whether it is physical, digital, personalized, or service-based, and any applicable law.
For purchases through third-party retailers or marketplaces, the applicable seller/platform policy generally governs the transaction.
For direct Awakened Sways purchases, the refund or return policy presented at the time of purchase or booking applies.
Nothing in these Terms is intended to eliminate consumer rights that cannot lawfully be waived.
17. Intellectual Property
Unless otherwise stated, original content created by Awakened Sways; including qualifying written materials, journal content, reflection prompts and collections, graphics, artwork, photographs, recordings, meditations, downloadable materials, website content, layouts, designs, and other original creative expression - is owned by or licensed to Awakened Sways and may be protected by applicable intellectual-property law.
Accessing or purchasing an Offering does not transfer ownership of the underlying intellectual property.
Unless expressly permitted, you may not reproduce, republish, distribute, sell, sublicense, commercially exploit, upload, substantially copy, or present protected Awakened Sways content as your own.
Personal-use materials may be used personally according to the terms accompanying them.
Nothing in this section claims exclusive rights in material that is not legally protectable.
18. Brand Names and Identifiers
Awakened Sways names, logos, branding, and identifiers may not be used in a manner that falsely suggests sponsorship, affiliation, endorsement, authorship, or ownership.
Nothing on this website grants permission to commercially use Awakened Sways branding except where express permission has been given.
19. Reviews, Testimonials, and Submitted Content
If you voluntarily provide a review, testimonial, photograph, story, or other material, Awakened Sways will not publicly use personally identifying submitted material as promotional content without appropriate permission where required.
Awakened Sways may decline to publish or may remove submitted content that is unlawful, misleading, abusive, infringing, or inconsistent with the context in which submissions were requested.
A testimonial reflects an individual's experience and does not establish that another person will experience the same result. Awakened Sways will not knowingly use testimonials to make health or efficacy claims that it could not lawfully make directly.
20. Acceptable Use
You agree not to intentionally use the website or interactive Awakened Sways spaces to:

attempt unauthorized access to systems or accounts;

engage in fraud or impersonation;

harass, threaten, exploit, or intentionally harm another person;

use community features for unauthorized spam or commercial solicitation.
Interactive community spaces may also be subject to a separate Code of Conduct.
21. External Links
The website may contain links to external websites, social platforms, marketplaces, resources, or services.
A link does not necessarily constitute endorsement of everything offered or expressed by the external provider.
Awakened Sways is not responsible for third-party content, availability, security, privacy practices, or independent actions.
22. Website Availability and Changes
Awakened Sways may modify, suspend, discontinue, add, or remove website content or Offerings from time to time.
Continuous, uninterrupted, or error-free access to the website is not guaranteed.
23. Disclaimer of Warranties
To the extent permitted by applicable law, the website and its general content are provided on an “as available” basis without guarantees that the website will always be uninterrupted, error-free, or suitable for every person's particular purpose.
Nothing in these Terms excludes warranties or consumer protections that cannot legally be excluded.
24. Limitation of Liability
To the extent permitted by applicable law, Awakened Sways will not be liable for indirect, incidental, special, exemplary, or consequential damages arising solely from use of or inability to use the website or an Offering.
Nothing in these Terms is intended to exclude or limit liability that cannot lawfully be excluded or limited.

25. Changes to These Terms
Awakened Sways may revise these Terms as the website, Offerings, applicable requirements, or business evolve.
The Last Updated date at the top identifies the most recent version.
Where required by applicable law, additional notice or consent will be provided.
26. Severability
If a provision of these Terms is determined to be unlawful or unenforceable, the remaining provisions will continue to apply to the extent permitted by law.
27. No Waiver
Failure to enforce a provision of these Terms on one occasion does not necessarily waive the right to enforce that provision later.
28. Governing Law
These Terms are governed by the law applicable to Awakened Sways and the particular transaction, subject to mandatory consumer protections and other applicable law.
